In this timely discussion Shawn Huston noted, “Cell phones are 'evidence creation devices' and whether you are using it or not, if it is powered on, it is generating and creating evidence and information.”

With the explosion of mobile data impacting legal matters in discovery, Tom O’Connor stated, “Cell phones have become an intrinsic part of eDiscovery because there is so much data on them that is going to be relevant in… business.” In regards to the attorney’s responsibility regarding cell phone data Tom summarizes, “We are walking around tethered to an enormous amount of information…and like it or not the obligation is there to preserve it.”
