Mesh lawsuits (http://www.vaginalmeshlawsuit2015.com//) involving product liability claims against Boston Scientific Corp. are moving forward in the multidistrict litigation underway in U.S. District Court, Southern District of West Virginia. According to a Pretrial Order dated August 7, 2013, Judge Joseph Goodwin has established parameters for the selection of cases for the litigation’s bellwether trials. The Order directs the parties to simultaneously submit amended bellwether selections by Monday, August 12, 2013, from which the Court will ultimately select five transvaginal mesh lawsuits for trial. According to the Order, the Court has scheduled three rounds of bellwether trials, with the first scheduled to begin on February 11, 2014. Transvaginal Mesh Lawsuits
Since 2008, transvaginal mesh products used to treat pelvic organ prolapse and stress urinary incontinence have been the subject of two U.S. Food & Drug Administration (FDA) safety alerts regarding the high rate of serious complications associated with such devices. Court documents indicate that more than 5,300 mesh lawsuits have been filed against Boston Scientific in the Southern District of West Virginia. Plaintiffs allege that various pelvic mesh products marketed by the company were defectively designed and manufactured. They further claim that Boston Scientific failed to provide adequate warnings to patients and doctors about their serious risks.
The Boston Scientific litigation is just one of several that have been established in the Southern District of West Virginia for vaginal mesh lawsuits. Bernstein Liebhard LLP partner, Jeffrey S.
