As Mirena lawsuit (http://www.filemirenalawsuit.com/) claims continue to mount in courts around the country, Bernstein Liebhard LLP notes that a federal judge in Kentucky has decided that Plaintiffs in one Mirena IUD lawsuit will be allowed to amend their complaint, after finding that it was inadequately pled. According to a decision rendered on October 16th, in U.S. District Court, Western District of Kentucky, rather than grant Bayer Healthcare Pharmaceutical’s motion to dismiss the claim, Judge Joseph H. McKinley Jr. determined that it was appropriate to grant the Plaintiffs leave to amend, as they had no chance to do so in the past. (Bosch, et al. v. Court records indicate that more than 400 Mirena lawsuits are currently pending in courts around the U.S., including 211 that have been filed in a federal multidistrict litigation now underway in U.S. District Court, Southern District of New York. The Mirena IUD has been on the market since 2000, and is approved as both a method of birth control and as a treatment for heavy menstrual bleeding in women who wish to use an IUD as their primary form of contraception. The FDA issued a warning letter to Bayer in 2009, after it determined that a Mirena promotion used by the company made misleading claims and downplayed the risk of serious Mirena complications. According to a report that aired on 7 Action News this past summer, the FDA has received more than 70,000 complaints involving Mirena, including thousands that detail cases of device dislocation and uterine perforation, since the device came on the market in 2000.*
