This is the fifteenth year the firm has published its summary of the decisions from the U.S. Supreme Court that have the greatest relevance to business.
"The Supreme Court issued a number of important business cases this Term," noted MoloLamken partner Robert Kry. "The Court issued major decisions on fraud, environmental law, and other topics affecting business," added Michael Pattillo, another firm partner.
In one of the Term's blockbuster decisions, the Supreme Court broadly rejected the use of universal injunctions to grant relief to persons other than the parties to the case. That decision has profound implications for businesses that may be affected by nationwide executive orders.
The Court upheld a statute that banned TikTok from the United States so long as the company remained under Chinese ownership. And in a rare international arbitration case, the Court held that the Foreign Sovereign Immunities Act does not require investors seeking to enforce awards against foreign state entities to show that the entities have minimum contacts with the United States.
The Supreme Court also issued two major environmental decisions. In one, the Court reined in judicial review of the environmental impact statements that federal agencies must prepare before building, funding, or approving new infrastructure. In the other, the Court allowed fuel companies to challenge California's stricter vehicle emissions standards even though the standards affected them only indirectly. Those decisions hand significant wins to businesses in disputes concerning climate change and other environmental issues.
The Supreme Court also addressed a number of other significant issues affecting business this Term. The Court departed from its trend of interpreting federal fraud statutes narrowly, holding that the government could prosecute a contractor for fraudulent inducement even if the agency suffered no economic loss. The Court made clear that majority-group plaintiffs are not subject to a more stringent standard when pursuing Title VII employment discrimination claims. And the Court expanded businesses' potential liability under the Racketeer Influenced and Corrupt Organizations Act to encompass claims for business and property losses that result from a plaintiff's personal injuries.
