Omaha, NE (PRWEB) October 04, 2016 -- Roundup®, the world’s most widely used herbicide, is now at the center of a Multidistrict centralized federal litigation.
The Judicial Panel on Multidistrict Litigation of the United States issued its order centralizing these cases in the United States District Court for the Northern District of California. Hon Vince Chhabria will preside over the litigation there.
The Judicial Panel decision came just 2 business days after the Panel heard arguments on centralization.
Monsanto Co., manufacturer of the herbicide, opposed the transfer of cases filed in federal courts in Nebraska California, Hawaii, Louisiana and elsewhere. Twenty-one lawsuits filed in 14 federal judicial districts across the country were consolidated. The panel was notified of another 16 related actions pending in 12 districts.
All responding Plaintiffs supported centralization under the Multidistrict litigation rules. Monsanto argued that individualized facts and informal coordination of discovery efforts were preferable to centralize to judicial supervision. The Judicial Panel noted, "We are not persuaded by either argument."
The panel noted that glyphosate is the central active ingredient in the herbicide, and that all of the cases “entail an overarching query – whether glyphosate causes non-Hodgkin's lymphoma in persons exposed to it while using Roundup®.”
