In “Brink v. Pereles,” attorneys Clem and Mitnik sued Juan Pereles, the vehicle’s driver, and his father, Juan de Los Santos (the owner of the vehicle), on behalf of Dustin Brink for a crash that occurred on April 5, 2008. According to court documents, Brink sustained a severe brain injury after his Kawasaki motorcycle was clipped from behind by Pereles’ car as the two parties went through an intersection in Kissimmee, Florida.
“Mr. Brink was able to achieve a stellar verdict in this tragic situation,” Clem said of the $25,927,183 verdict. “The jury’s verdict was a just and righteous acknowledgment of Dustin Brink’s diminished cognitive abilities. For the rest of his life, he will live with a significant frontal lobe injury that has profoundly diminished his day-to-day functional capacity.”
Although the final verdict was substantial, the plaintiff’s net award was reduced to $13 million after the jury ruled Brink was comparatively negligent in causing the accident, likely because he was not wearing a helmet. Despite the reduction in damages, Clem and Mitnik feel that justice was ultimately served for their client.
“Though it’ll never fix or resolve what he’s going through, the jury’s verdict ultimately will be able to help him,” Mitnik said. “At some point, Dustin Brink will be compensated for his life-altering brain injury so that he can obtain the necessary help and assistance to improve his quality of life.”
Brink, a 31-year-old Iraq War veteran, lost “executive brain function” because of the crash, including his ability to “plan, organize and sequence” his thoughts. After the crash, Brink spent several days in a coma and underwent many months of speech, occupational, and physical therapy at the Tampa V.A. hospital. Clem and Mitnik, veteran plaintiffs’ advocates, say that it’s never easy to witness clients go through the trauma of a life-altering injury.
“This is a guy who used to be able to assemble and disassemble a Harley Davidson motorcycle down to the last lug nut, and now he doesn’t know how to use a flat head screw driver,” Mitnik and Clem said. “As plaintiffs’ advocates and personal injury lawyers, you really have to get to know your client and understand how their injuries have affected his or her life. Dustin’s losses are deeply saddening.”
