Motion for Temporary Restraining Order and Preliminary Injunction filed against EBF Partners, LLC D/B/A Everest Business Funding
Capsule Media Group, LLC filed a Motion in the United States District Court for the District of Delaware to prevent the misappropriation of commissions.
LOS ANGELES, Aug. 9, 2019 /PRNewswire-PRWeb/ -- Capsule Media Group, LLC is in the business of referring merchants seeking to sell portions of their future revenue stream (at a discount) to purchasers of such revenue streams. EBF Partners, LLC d/b/a Everest Business Funding, one such purchaser, entered into an agreement with Capsule pursuant to which Capsule would refer merchants to Everest in exchange for commissions based on the initial revenue purchase and commissions on subsequent revenue purchases.
Capsule Media Group, LLC announced that it filed a Motion for Temporary Restraining Order on Notice and Preliminary (the "Motion") against Everest in the United States District Court for the District of Delaware. The Motion filed today, seeks to enjoin Everest from allegedly attempting to unjustly enrich itself by denying Capsule its renewal commissions on clients referred to Everest by Capsule.
The Motion further alleges that as Capsule began referring fewer and fewer merchants to Everest, Everest determined that it could effectively steal the renewal commissions from Capsule by terminating the agreement, however improperly, and then blocking Capsule's access to the information required to effectuate renewals.
Promptly upon filing the Motion, the Court granted a hearing for Monday.
