New York Attorney Joe Stanley Helps Survivors of Sexual Abuse Obtain Justice
Attorney Joe Stanley, founder of Stanley Law, examines the New York State Revival Statute for the Child Victims Act and how people who were abused in the past can file a claim.
SYRACUSE, N.Y., Feb. 21, 2019 /PRNewswire-PRWeb/ -- The New York State Assembly recently passed a new law regarding abuse cases called the Revival Statute for the Child Victims Act. Senate Bill S2440 raises the criminal statute of limitations for child sexual abuse crimes by five years and the civil statute of limitations for causes of action brought by someone seeking redress for physical, psychological or other injury caused by child sexual abuse to age 55.
"We believe the Governor is going to sign it this month," said Stanley. "If Governor Cuomo signs it into law, people who were abused as children many years ago will have one year from the date the Governor signs it to implement a claim. It doesn't mean you have to come forward now, but you should know your rights."
In the past there was a statute of limitations on any abuse case. For the next year and the next year only, all statutes have been lifted. "That means you could be in your 30s, 40s, or 50s, like the person I've just helped in a similar case, and if the abuse happened years ago, you now have a claim and can take that person to court to hold them accountable for what they did to you," noted Stanley.
If one does choose to act, however, they need to know all of their rights, which a good attorney can help them understand. "If you're an adult survivor of childhood abuse, you may just now be in the process of starting to understand how the abuse has affected your life," concluded Stanley. "You may have also recently learned that someone you trusted failed to protect you and allowed the abuse to occur. Sadly, you're not alone and you don't have to go it alone now."
