On December 18, 2015, Congress passed two bills totaling more than 2,200 pages. Included in the legislation was a permanent $500,000 Section 179 expensing limit, as well as a bonus depreciation extension. President Obama signed both bills into law.

Section 179 includes a provision that enables small businesses to expense up to $500,000 of investments of heavy machinery or office equipment instead having to depreciate the cost over a number of years. This is important news for those purchasing portable restrooms and shower trailers, as these mobile sanitation solutions can cost well above the old cap of $25,000. In recent years, the $500,000 was extended on a year-by-year basis, but often not until mid-to-late December, leaving businesses scrambling to purchase in time.
Congress is hopeful that making the $500,000 limit permanent, and indexing it for inflation, will give businesses the push they need to make new investments and create more jobs. The provision is retroactive as of January 1, 2015 and is available to companies whether they pay cash or finance their purchase. Analysts estimate the new legislation will provide roughly $77 billion in tax relief over the next 10 years to small businesses using Section 179.
Another Section 179 incentive to buy new business equipment is a depreciation clause, available to businesses of all sizes. Extended through 2019, this provision will allow businesses to depreciate 50 percent of the cost of property acquired and put in service during 2015, 2016, and 2017. The final two years will see reduced percentages, with 40 percent in 2018 and 30 percent in 2019.
