As a result of the efforts of Sacramento Mental Health Attorney Ken Rosenfeld, the client has been accepted for placement into San Diego's Behavioral Health Court, a collaborative courts program for mental health treatment affiliated with the San Diego Superior Court.
According to the April 12, 2023, officer's report by the San Diego County Probation Department, Kevin B. was charged with multiple felonies based on two alleged incidents on August 15 and August 27 of 2021, consolidated into one case: a felony count of assault by means likely to produce great bodily injury pursuant to California Penal Code §245(a)(4), and a count of elder abuse pursuant to PC §368 (b)(1) with the enhancement PC §12022.7(a), committing a felony while on bail or O.R. release. According to the probation officer's report, Mr. B. had been diagnosed with schizoaffective disorder in 2011 and had a history of mental health episodes since that time.
Intervening on behalf of his client, Rosenfeld established that the schizophrenia suffered by Mr. B. is consistent with the type of serious mental illnesses (SMI) addressed by the San Diego Behavioral Health Court, and requested that he be screened by the Behavioral Health Supervision Unit. As a result of this and a negotiated plea agreement in which Mr. B. pled guilty to the count of elder abuse, the other charges against him were dismissed, and Kevin B. received three years of probation and a place in the Behavioral Health Court program, which will provide 18 months of assertive community mental health treatment and ongoing court supervision.
Rosenfeld stated that his Sacramento firm was pleased to have won a mental health case as an outside firm in San Diego.
