Scott Hirsch of Scott Hirsch Law Group, PLLC, Joshua Entin of Entin Law Group, P.A., and Erika Rodriguez of Rodriguez Law & Advocacy, P.A, announced the filing of a federal lawsuit in the United States District Court Southern District of Florida on behalf of Matthew Rodriguez and Otis Clayton, individually and for additional inmates incarcerated within the Florida Department of Corrections ("FLDOC") facilities on a Class Action basis against Defendants JPay, Inc. ("JPay") and Keefe Commissary Network, LLC, ("Keefe") aka "Access Corrections", both vendors of the FLDOC for allegations ranging from aiding and abetting fraud, to common law conspiracy, to unjust enrichment in regards to their Digital Music Player Program.
The program's vendors have quickly become the "iTunes" of Florida's prison system, and the Plaintiffs allege that millions of dollars in profits were fraudulently realized by the Defendants after previous, original digital media vendor contract with Keefe were replaced in April of 2017 with more profitable contract with JPay to the great loss of the inmates. The lawsuit alleges that inmates were enticed and encouraged to purchase digital media players, files and accessories through multiple ads distributed in a variety of methods at various corrections institutions, just to have the vendor contracts replaced and the digital media files deemed inaccessible. These ads promised that once the prisoners purchased the digital medial players they'd permanently own the music and other media files that were also purchased and downloaded. That, however, proved to be untrue once the contract was replaced, according to the filing in the U.S. District Court, Southern District of Florida.
Relying on the ad misrepresentations made by the FLDOC and their vendors, the lawsuit states that the inmates were induced into buying over 6.7 million digital media files through the vendor's Digital Music Player Program, at a cost of approximately $11.3 million in to those inmates and their families between the years 2011 to 2017. The FLDOC received commission payments from the vendor totaling approximately $1.4 million, and Keefe and JPay realized millions in profits.
In a joint statement, the attorneys representing the Plaintiffs said, "It is critical not on only for Mr. Rodriguez and Mr. Clayton, but for all Florida corrections inmates who have been affected by this matter to receive justice. As the Plaintiffs are paying their debts to society, we have a civic, social, and ethical responsibility to ensure that the lawmakers and enforcers are, in fact, following the law themselves."
