Section 781 leaves one question open: how will a seed's status be verified? 59% of buyers would buy seeds before the change, even without plans to grow soon.
NEW YORK, Oct. 22, 2026 /PRNewswire-PRWeb/ -- Section 781 changes the rules for cannabis seeds but leaves one question open: how will anyone verify a seed's status? Even with that unanswered, 59% of buyers say they would buy seeds before the change, even if they did not plan to grow them soon. Herbies Seeds took the name of the provision, put it on a strain, and built a Growers Challenge around it.
Ask a grower where strain names come from and you'll hear about flavors, parents, places, maybe a famous high.
Herbies Seeds named its latest strain after a federal provision.
The new Section 781 comes in three versions: Photoperiod, Autoflowering and Fast Flowering. Alongside the launch, Herbies Seeds is opening the Section 781 Growers Challenge, where participants document their grows from seed to harvest and compete for prizes.
The strain was created with Blimburn Seeds, the project's genetics partner. The original version is based on OG Kush × Strawberry Diesel.
WHY NAME A STRAIN AFTER A LAW?
Section 781 rewrites the federal definition of hemp, and that includes viable cannabis seeds.
The seed-related provision is set to apply from December 11, 2026. From then on, a seed's status is tied to the plant that produced it. If that plant exceeded 0.3% total THC, including THCA, on a dry-weight basis, the viable seed falls outside the federal definition of hemp.
So it is not the THC of the seed itself, and not the THC potential of the plant it may grow into. It is the THC of the plant that produced the seed. The law sets that criterion but does not explain how it should be verified for a particular pack of seeds.
In a Herbies Seeds survey of 432 U.S. customers, only 12.7%, about 1 in 8, identified the THC of the plant that produced the seed as the measure that matters under Section 781. Another 50.7% said they did not know. Still, 58.8% said they would buy seeds before the change even if they had no plans to grow them soon.
ONE BASE, THREE VERSIONS
The lineup is built around high-potency genetics, with stated THC reaching up to 33%, and comes in three versions for different growing styles.
Section 781 Photoperiod is where the line started: sativa-dominant, based on OG Kush × Strawberry Diesel, with 56 to 70 days in flower.
The Autoflowering version brings in Ruderalis and goes from seed to harvest in 77 to 87 days.
Fast Flowering adds a secret hybrid, leans indica and finishes flowering in 50 to 55 days.
HOW THE GROWERS CHALLENGE WORKS
Think of the challenge as a public grow test: one genetic concept, different growers, climates and setups.
Participants choose a version, register at 781.family and document the grow from seed to harvest in the free HarvestED app.
The Challenge is supported by AC Infinity, Grove Bags and Secret LED. Prizes include a $600 Herbies gift card, an AC Infinity Cloudray S9, and a Secret LED SL-1000 for the special Best Looking Plant award.
Registration is open until December 30, 2026. Participants are responsible for complying with applicable state and local laws.
