Sergei Lemberg, Attorney for Noah Duguid in Pending Supreme Court Case of Duguid v. Facebook, Warns About the Danger of Robocalls and Robotexts
In Duguid v. Facebook, Facebook and the U.S. Attorney General are asking the Supreme Court to gut the Telephone Consumer Protection Act. If they're successful, marketers, politicians, and social media companies will be able to robocall and robotext consumers without their consent.

In the wake of that riot, Facebook snatched away President Trump's megaphone. Consumer attorney Sergei Lemberg (https://www.lemberglaw.com) reminds politicians and the public that politicians', marketers', and Facebook's ability to robocall and robotext consumers without consent is at stake in the Supreme Court's upcoming Duguid v. Facebook decision.
Lemberg called out Facebook for hypocrisy. "Facebook's about-face is disingenuous, given that the company has worked hand-in-glove with President Trump's Department of Justice to gut the Telephone Consumer Protection Act."
In Duguid v. Facebook (Docket 19-511, U.S. Supreme Court.), argued on behalf of Lemberg's client before the U.S. Supreme Court on December 8, 2020, the U.S. Justice Department backed the social media platform in arguing that 1991's Telephone Consumer Protection Act (TCPA) doesn't prohibit unwanted robotexts and robocalls generated by auto-dialers.
Lemberg notes that the implications of the Duguid case shouldn't be lost in the wake of troubling post-election events. "Facebook, together with the U.S. Attorney General, is asking the High Court to gut the TCPA," he said. "If the Supreme Court agrees, political campaigns and marketers alike will be able to robocall and robotext consumers, with or without their consent." Given that Americans received an estimated 3 billion election-related robocalls and texts during the 2020 cycle, Lemberg sees the potential for a tsunami of unwanted texts and calls, some with questionable intentions.
While Lemberg welcomes the Court's upcoming decision, he declares, "The goal here should be to reduce unwanted calls and texts, not expand the ability of marketers and politicians alike to harvest and sell users' information, then use it to flood our cellphones."
