Effective January 1, 2021, Maryland's infertility insurance law no longer has a marriage requirement, and the 2-year "waiting" period has been reduced to 1 year of unprotected sexual intercourse or three attempts of artificial insemination in the course of a year.
SGF applauds RESOLVE: The National Infertility Association, of whom Shady Grove Fertility is a visionary partner, for their advocacy work. The Governor and the Maryland legislature are updating the state's insurance law—which was the first infertility insurance law in the country in 1985—to cover unmarried patients and more closely align with the guidelines of the American Society for Reproductive Medicine (ASRM).
Many Marylanders have an advantage over residents of other states when it comes to infertility insurance legislation, known as the Maryland Mandate, as Maryland was the first state in the nation to enact infertility insurance legislation and was the third state that also covers fertility preservation prior to cancer treatment.
Currently, 19 states have passed laws that require health insurance coverage be offered for or actually cover an infertility diagnosis and/or fertility treatment, and ten states have fertility preservation laws for iatrogenic, or medically induced, infertility. Over 90 percent of SGF patients with insurance have coverage for their initial consult, and at least 70 percent have some level of coverage for testing and/or treatment.
