Southern District of New York Settles False Claims Act Case Against Multi-State Provider Group Servicing Medicare and Medicaid Patients
New York, NY (PRWEB) July 22, 2013 -- Joshpe Law Group LLP announces finalization of a False Claims Act settlement with Park Avenue Medical Associates, a multi-disciplinary provider group servicing Medicare and Medicaid patients at over 100 facilities throughout New York, Connecticut and Massachusetts. The case was filed under seal in July of 2011 by Joshpe Law Group on behalf of former employee and whistleblower, Zachary Wolfson, whose father is a company executive. Wolfson alleged that the company was overbilling Medicare and Medicaid and rendering unnecessary treatments to patients. The Department of Justice intervened in the case in March of this year.
Joshpe Law Group released a statement, saying, “Thanks to our client’s tenacity and the outstanding work of the U.S. Attorneys’ Office for the Southern District of New York, with assistance from the New York Attorney General’s Office, this matter was resolved both successfully and extraordinarily quickly. Taxpayers and patients will both benefit long-term.”
Attorney Brett Joshpe added, “With so much of state and federal budgets attributable to healthcare, the nation faces a fraud and waste crisis. When firms or individuals commit fraud against the government, we are all victims as taxpayers. That is why the role of courageous whistleblowers is so important.”
Last year alone, the Department of Justice recovered nearly $5 billion under the False Claims Act. The majority was attributable to false claims associated with federal and state healthcare programs. Under the False Claims Act, whistleblowers typically receive a portion of the government’s recovery.
Joshpe Law Group LLP is a Manhattan-based boutique law firm that represents whistleblowers, as well as handles corporate and litigation matters.
