Highlights of selected legislation covered in the newly developed protocol include:
- "Government Notice No. 687 of May 22, 2019" amends the list of activities which result in atmospheric emissions which have or may have a significant detrimental effect on the environment, including health, social conditions, economic conditions, ecological conditions or cultural heritage published under "Government Notice No. 248 of March 31, 2010, in Terms of Section 21 (1)(b) of the National Environmental Management: Air Quality Act, 2004 (Act No. 39 of 2004). Government Notice No. 687 is referred to as the Listed Activities and Associated Minimum Emission Standards Identified in Terms of Section 21 of the National Environmental Management: Air Quality Act, 2004 (Act No. 39 of 2004)."
- The "Carbon Tax Act 15 of May 22, 2019" provides for the imposition of a tax on the carbon dioxide (CO2) equivalent of greenhouse gas emissions and for matters connected to it. This Act entered into force on June 1, 2019. The Act covers the tax base and how and who must pay it and designates the Department of Environmental Affairs as the body that will assist with the reporting, the method of calculating, and approval.
- "General Notice No. 275 of April 3, 2017" was adopted under the "National Environmental Management: Air Quality Act, 2004" and is referred to as the "National Greenhouse Gas Emission Reporting Regulations, 2016." This Notice introduces a single national reporting system for a transparent reporting of greenhouse gas emissions which will be used to update and maintain a national inventory of greenhouse gas, for the country to meet its reporting obligations under the United Framework Convention on Climate Change and its instrument treaties, and to inform the formulation and implementation of legislation and policy.
- "Government Notice 710 of July 21, 2017" declares the listed greenhouse gases as priority air pollutants, and requires persons falling within the category specified in Annexure A to prepare and submit to the Minister pollution prevention plans for approval. This Notice, referred to as the "Declaration of Greenhouse Gases as Priority Air Pollutants," is issued under the "National Environmental Management: Air Quality Act, 2004."
- "Government Notice 71 of February 1, 2019" gives notice of the procedure to be followed for the registration and reporting by Category A Data providers in terms of the "Greenhouse Gas Emission Reporting Regulations 2016 (General Notice No. 275 of April 3, 2017)." This Notice is referred to as the "National Greenhouse Gas Emission Reporting Regulations."
- "Government Notice 712 of July 21, 2017" prescribes the requirements that pollution prevention plans of greenhouse gases declared as priority air pollutants need to comply with the "National Environmental Management: Air Quality Act, 2004." These Regulations are also referred to as the "National Pollution Prevention Plans Regulations, 2017."
- "Government Notice No. 1064 of September 29, 2017" regulates the storage, disposal, tyre waste abatement and management plan. The Notice, also referred to as the "Waste Tyre Regulations, repeals Government Notice No. 149 of 2009."
- "Government Notice 382 of March 15, 2019" covers the requirements for a permit to discharge wastewater to coastal waters ibn application of Section 69 (3) of the "National Environmental Management: Integrated Coastal Management Act 24 of 2008." "Government Notice 382," also referred to as the "Coastal Waters Discharge Permit Regulations, 2019," is adopted in application of the "National Environmental Management: Integrated Coastal Management Act 24 of 2008."
- The "National Environmental Management: Integrated Coastal Management Act 24 of 2008" was added to this update. This Act determines the coastal zone of South Africa to provide, within the framework of the "National Environmental Management Act," for the co-ordinated and integrated management of the coastal zone by all spheres of government in accordance with the principles of co-operative governance to: preserve, protect, extend and enhance the status of coastal public property as being held in trust by the State on behalf of all South Africans, including future generations; secure equitable access to the opportunities and benefits of coastal public property to provide for the establishment, use and management of the coastal protection zone; and give effect to the Republic's obligations in terms of international law-regarding coastal management and the marine environment.
- "Government Notice R. 541 of June 24, 2015" was added to this update. This Notice, also known as "Incorporation of Safety Standards Into the Driven Machinery Regulations," incorporates listed standards into the "Driven Machinery Regulations, 2015."
- "Government Notice R. 828 of September 17, 2010" was added to this update. This Notice, known as the "Lift, Escalator and Passenger Conveyor Regulations, 2010," sets forth requirements for the design, installation, inspections, maintenance and recordkeeping for lifts, escalators and passenger conveyors.
- "Government Notice R. 829 of September 17, 2010" was added to this update. This Notice, also known as the "Incorporation of Safety Standards, incorporates listed standards into the Lift, Escalator and Passenger Conveyor Regulations, 2010."
- "Government Notice R. 94 of February 3, 2017" was added to this protocol. This Notice, known as the "Code of Practise for Existing Goods Hoists Installations, Lift, Escalator and Passenger Conveyor Regulations, 2010," sets forth requirements for good hoists installed before September 30, 2015, that were previously regulated under the "Driven Machinery Regulations, 1998" (now repealed).
- "Government Notice R 638 of June 22, 2018" establishes the minimum hygiene requirements for facilities that prepare, serve and transport food. This Notice, which issues the "Regulations Governing General Hygiene Requirements for Food Premises and Transport of Food and Related Matters (promulgated under the Foodstuffs, Cosmetics and Disinfectants Act)" repeals "Government Notice 962 of November 23, 2012."
