Facing multiple felony charges, and qualifying as a third-strike offender due to previous serious felony convictions, Dwayne Sterling Lawson faced life in prison. According to the May 4, 2022, court documents filed with the San Joaquin County Superior Court, Dwayne Sterling Lawson was taken into custody in Nevada in December of 2017 and was committed to serve a prison sentence of 24 to 114 months; however, a Stockton Police Department detainer was filed with the Nevada Department of Corrections requesting extradition. As per the complaint filed with the San Joaquin County Superior Court, Lawson was accused by the San Joaquin district attorney of the felonies of human trafficking, kidnapping, pimping, criminal threats, and felon/addict possession of a firearm. The complaint also refers to prior serious felony convictions of voluntary manslaughter and burglary in the first degree for Lawson, both of which, if convicted, qualified Lawson for a third-strike sentence (25 years to life) according to California's Three Strikes sentencing law.
Rosenfeld argued that, despite his client's compliance in filing the appropriate written notice of his imprisonment in a Nevada state prison and his request to the Stockton court for a disposition of charges according to the Interstate Agreement on Detainers, the prosecuting attorneys in California failed to bring Lawson to trial within 180 days. Rosenfeld therefore made the motion, pursuant to Penal Code 1389, to dismiss all charges against his client. The motion was granted.
