In this case, in addition to the elements of damages mentioned above, the claimant also received a sizeable award for unreimbursed medical expenses and an amount sufficient to pay for an annuity contract to cover life care expenses into the future, according to court documents.

Although the specific causes of GBS remain unknown, the federal government concedes and pays those claims where individuals who receive the flu shot can demonstrate an onset of symptoms that began within 3-42 days of vaccination, Durant says. According to Durant, the CDC acknowledges that certain forms of Guillain-Barre Syndrome and CIDP have been linked to the annual flu shot, and while individuals diagnosed with GBS have always been eligible to file claims under the National Vaccine Injury Compensation Program, important changes to Federal law have made it easier for individuals diagnosed with this disease to recover financial compensation. In all cases, the National Vaccine Injury Compensation Program provides compensation on a no-fault basis, Durant explains. To date VICP claimants have received more than $3.7 billion for their vaccine-related injuries.
