The client, a company specializing in in-store sampling, merchandising, and field sales for natural and organic consumer brands, was contracted by another business to execute product demonstrations across grocery stores in select U.S. markets. Per the terms of the agreement, the client was to receive payment in two installments: an initial upfront payment and a second payment due upon near-completion of the project.
Despite receiving repeated verbal assurances from the opposing party that payment was forthcoming, the second installment was never remitted. The client made multiple good-faith efforts to resolve the matter, including offering an installment payment plan—none of which were answered.
After exhausting all informal avenues, Trembly Law Firm filed suit in Pennsylvania—the venue agreed upon in the contract—obtaining Pro Hac Vice admission to represent the client. Just one week before the defendant's response deadline, the opposing party contacted the firm to pursue a resolution.
Following strategic negotiation, Trembly Law successfully secured a settlement for the full outstanding amount owed, along with prejudgment interest and a substantial portion of the client's attorneys' fees.
