Ethicon Transvaginal Mesh Lawsuit Update: Bernstein Liebhard LLP Notes Issuance of New Order in Federal Ethicon Mesh Litigation
New York, New York (PRWEB) January 08, 2014 -- Thousands of transvaginal mesh lawsuits (http://www.vaginalmeshlawsuit2015.com/ ) filed against Ethicon, Inc. continue to move forward in a multidistrict litigation now underway in U.S. District, Southern District of West Virginia, Bernstein Liebhard LLP reports. According to a Pretrial Order dated January 7, 2014, the Court has issued a Stipulated Protective Order that governs the production of certain non-party documents. The Order will apply to all documents produced in accordance with certain subpoenas issued by defendants Ethicon, Inc. and Johnson & Johnson. Transvaginal Mesh Lawsuits
According to court documents, Johnson & Johnson and its Ethicon unit are named as defendants in more than 13,000 transvaginal mesh lawsuits currently pending in the Southern District of West Virginia. All of the lawsuits allege that the companies’ Gynecare pelvic mesh products were defectively designed and manufactured, and caused recipients to suffer painful and life-changing vaginal mesh complications, including mesh erosion through vaginal tissue, organ damage, infections, and chronic pain. The federal proceeding’s first bellwether trial of an Ethicon mesh lawsuit is scheduled to begin on February 10, 2014.
In addition to the transvaginal mesh lawsuits pending in West Virginia, Ethicon and Johnson & Johnson are named in 4,600 similar claims that have been filed in a multicounty litigation underway in New Jersey’s Atlantic County Superior Court. Bernstein Liebhard LLP partner, Jeffrey S. Grand, is serving as Co-Liaison Counsel for this proceeding, and was also a member of the Plaintiff’s trial team for the litigation’s first trial. That case concluded in March with an award of more than $11 million in compensatory and punitive damages to a woman who suffered vaginal mesh complications due to the Gynecare Prolift device. In addition to his work with the Ethicon litigations, Mr. Grand, is also serving on the Plaintiffs’ Steering Committees for three other federal vaginal mesh proceedings underway in the Southern District of West Virginia, including: American Medical Systems, Inc. (MDL No. 2325);Boston Scientific Corp., (MDL No. 2326); and C.R. Bard, Inc., (MDL No. 2187).
