SAN FRANCISCO, Mar. 16, 2021 /PRNewswire-PRWeb/ -- The San Francisco labor law attorneys, at Zakay Law Group, APLC and JCL Law Firm, APC, filed a complaint alleging that TVI, Inc. committed multiple violations of the California Labor Code. The TVI, Inc. lawsuit, Case No. 21CV376407, is currently pending in the Santa Clara County Superior Court of the State of California. A copy of the Complaint can be read here.
The lawsuit alleges TVI, Inc. violated the Private Attorneys General Act ("PAGA"), which gives rise to civil penalties as a result of TVI, Inc.'s conduct. PAGA authorizes aggrieved employees to file a lawsuit to recover civil penalties on behalf of themselves, other employees, and the State of California for Labor Code violations. An "aggrieved employee" is defined as "any person who was employed by the alleged violator and against whom one or more of the alleged violations was committed." Cal. Lab. Code section 2699(c). PAGA allows aggrieved employees to become "deputized" as private attorneys general to enforce the Labor Code.
The complaint alleges TVI, Inc. violated the California Labor Code by failing to: (1) provide compliant meal and rest periods; (2) allow employees to take duty-free, off-the-premises rest periods; (3) pay all minimum, regular and overtime wages; (4) pay the correct rate of overtime pay; (5) provide suitable seating; (6) provide accurate itemized wage statements; (7) pay employees for time spent getting their bags checked; and (8) timely pay earned wages.
