New York Lawyer Edgar N. Romano Comments on Report Revealing Devastating Impact of ‘Reform’ on Injured Workers

The New York City workers’ compensation attorney at Pasternack Tilker Ziegler Walsh Stanton & Romano, L.L.P., says the system is tilted in favor of businesses and insurance companies, which is why injured workers should seek legal advice.

Today, even seemingly minor cases can become a legal headache for injured workers and their families. That’s why we urge people to consult with an experienced attorney as soon as possible after an injury.

New York workers’ compensation attorney Edgar Romano said today all workers should be aware of a recent investigation by ProPublica and NPR which details drastic cutbacks to the workers’ comp system over the past 10 years.

The dismantling of the system throughout the country has had disastrous consequences for the hundreds of thousands of people who have sustained serious injuries at work, according to the report posted March 4, 2015, at (“Injured Workers Suffer As ‘Reforms’ Limit Workers’ Compensation Benefits”).

The report cited New York as one of three states that have cut back compensation for workers with permanent partial disabilities, such as debilitating back injuries, by at least 20 percent.

“As workers’ compensation attorneys, we have seen the impact of these cutbacks firsthand,” said Romano, an experienced work injury lawyer at Pasternack Tilker Ziegler Walsh Stanton & Romano, L.L.P. “Some injured workers tell us their claims were denied or they ran into other obstacles. This investigation supports what we have heard from people.”

Romano said the report illustrates why injured New Yorkers should discuss their cases with an attorney, even if they believe their claim will be straightforward.

According to NPR, workers’ comp cutbacks have resulted in financial devastation for people injured on the job. The report describes how people making claims often have to fight insurance companies for years to get doctor-recommended surgeries, prescriptions and basic help.

“Years ago, people could get by without hiring an attorney if they had a minor workplace injury,” Romano said. “Today, even seemingly minor cases can become a legal headache for injured workers and their families. That’s why we urge people to consult with an experienced attorney as soon as possible after an injury. A lawyer can start by making sure you fill out the necessary forms and meet all the deadlines. Our attorneys understand how to gather medical evidence that details the severity of the condition. We are well-versed in workers’ compensation law and know how to help victims navigate the system.”

The NPR report states that the changes have been backed by big businesses and insurance companies “on the false premise that costs are out of control.” The NPR and ProPublica investigation notes that employers are paying the lowest rates for workers’ compensation insurance since the 1970s. Insurance companies had their most profitable year in 2013, with an 18 percent return, according to NPR.

“We hope our lawmakers take a close look at this report. It clearly shows how the basic protections for injured workers have eroded,” Romano said. “At a time when workers’ comp claims are more complex than ever, we believe injured workers can still fight for their rights. Our job as attorneys is to advocate for injured workers so they can get the benefits the need.”
