Wright Hip Lawsuit News: Federal Judge Allows Certain Claims to Proceed in Wright Profemur Hip Replacement Lawsuit, Bernstein Liebhard LLP Reports
New York, New York (PRWEB) October 22, 2013 -- A federal judge in Georgia has ruled that a recipient of the Wright Profemur Hip Replacement (http://www.consumerinjurylawyers.com/wright-profemur-hip-replacement) will be able to pursue certain claims put forth in a Wright hip lawsuit pending in the U.S. District Court, Middle District of Georgia, Bernstein Liebhard LLP reports. In an Order dated October 11, 2013, Judge C. Ashley Royal allowed the Plaintiff’s design defect claims on the Profemur hip and an extraction device used to remove its fractured femoral component to stand. The Plaintiff will also be able to pursue his manufacturing defect claim on the extraction tool and failure to warn on the Profemur Hip Replacement System. (Courson, et ux. v. In April, Wright Medical Group, Inc. disclosed in a regulatory filing that it had been named a defendant in a number of lawsuits filed on behalf of Wright Profemur hip replacement recipients who allegedly suffered complications associated with the fracturing of the Profemur long titanium modular neck product.* Court documents filed in March in U.S. District Court, Northern District of California also indicated that the company had reached a settlement in at least one claim pertaining to the Profemur hip. Court filings also show that Wright Medical Group is named in 74 federally-filed Wright hip lawsuits involving its Conserve line of metal-on-metal hips, all of which are pending in a multidistrict litigation underway in U.S. District Court, Northern District of Georgia. All of these claims allege that various Wright Conserve hip replacements, including Conserve Total Hip Implant System, Conserve Total A-Class Advanced Metal Hip Implant System, and the Conserve Resurfacing System, caused plaintiffs to suffer debilitating complications that often necessitate revision of the hip implant.
