AUSTIN, Texas, Aug. 12, 2021 /PRNewswire-PRWeb/ -- The Fifth Circuit Court of Appeals affirmed the earlier district court decision in favor of the City of Cedar Park in a commercial billboard dispute with Reagan National Advertising of Austin, Inc. on August 6, 2021.
Reagan sued the City of Cedar Park after the City denied the national advertising company five permit applications; it alleged the City's denial constituted a First Amendment Rights violation. Richards Rodriguez & Skeith LLC successfully represented the City before both the district court and the Fifth Circuit in the matter.
In March 2017, the City denied five permit applications submitted by Reagan to convert three existing billboards and construct two new billboards with LED displays. In June 2017, Reagan sued the City, alleging that the City's denial constituted a violation of its First Amendment rights under the United States Constitution. The United States Western District Court ruled against Reagan after a series of motions; Reagan appealed this decision to the Fifth Circuit Court of Appeals.
In its affirmation of the lower court decision, the Fifth Circuit rejected Reagan's First Amendment claims and upheld the City's denial of permits under its sign code and affirmed that the signs were not treated differently on the basis of content.
