Grace Episcopal Alexandria Lawsuit Moves Forward, Plaintiff Invokes Federal Stored Communications Act
Plaintiff Eric J. Bonetti asks Federal District Court to Prevent Defendant from Accessing Website
ALEXANDRIA, Va., May 5, 2021 /PRNewswire-PRWeb/ -- Eric Bonetti, the first person married to a same-sex partner at Grace Episcopal Church in Alexandria, VA, has asked the Federal District Court for the Eastern District of Virginia to prevent the Rev. Robert H. Malm, a defendant in the case, and members of his family, from accessing the Plaintiff's blog in a case docketed at 1:21-cv-00190.
In pleadings filed with the Court, Bonetti, a retired attorney, invokes the federal Stored Communications Act, alleging that the blog is protected by multiple levels of security designed to prevent Malm or persons living near him from accessing the blog. The pleadings further allege that the website terms and conditions expressly forbid Malm, his family, or anyone acting on his behalf from accessing the blog, but that Malm or members of his family continue to attempt to access the blog, first from locations in Massachusetts, and more recently in Georgia.
The pleadings ask the Court to enforce the site's terms and conditions, including preventing Malm and his family from accessing the site or attempting to bypass the website's security features.
Also named in the suit are the Episcopal Dioceses of Virginia and Massachusetts, the City of Alexandria Virginia, and the Commonwealth of Virginia.
The Plaintiff has asked the Court to consider the motion at a hearing in late May.
