The lawsuit is the result of a business deal gone wrong between Vision Pharma, LLC (Plaintiff) and the company it outsourced the manufacture of some its drugs to, Sterling Pharmaceutical Services, LLC (Defendant).

OPINION AND ORDER
This matter comes before the Court on Defendant's Motion to Dismiss Second Amended Complaint (Doc. 39) filed on December 28, 2018. Plaintiff filed a Response in Opposition (Doc. 42) on January 18, 2019. For reasons set forth, the Motion is denied.
