$1.43 Billion Stryker Hip Replacement Lawsuit Settlement Reached With Stryker Corp., The Oliver Law Group, P.C., Reports
Chicago IL (PRWEB) November 04, 2014 -- The Oliver Law Group P.C. reports that Stryker Corp. has reached an agreement to pay $1.43 billion to compensate hip implant recipients who had revision surgery to replace the company’s recalled Rejuvenate Hip Stem and ABG II Modular-Neck Hip Stem implants, before November 3, 2014. A news release posted on the Stryker Modular Hip Settlement website announced the settlement and said that the majority of the payments will be made by the end of 2015. According to Stryker’s website, the settlement came as a result of an early mediation program initiated in New Jersey’s Bergen County Superior Court. The mediation resulted in the resolution of “multiple suits and claims” in state and federal courts. While the news release did not specify how many people are eligible for compensation, court records indicate that more than 4,000 Stryker hip replacement lawsuits have been filed in state and federal courts on behalf of individuals who had Stryker recalled hip implants. According to the company’s website, the settlement will resolve a significant number of Stryker hip replacement lawsuits, although some complaints will continue in litigation.

Court documents indicate that the Stryker hip recall complaints have been consolidated in the U.S. District Court, District of Minnesota and the 1,908 cases are being supervised by U.S. District Judge Donovan Frank.(In Re: Stryker Rejuvenate and ABG II Hip Implant Products Liability Litigation, MDL No. 2441) Stryker hip complaints have also been consolidated in a tort program in New Jersey’s Bergen County Superior Court where Judge Brian R. Martinotti is presiding over the pretrial proceedings for the 2,148 pending lawsuits. (In Re: Stryker Rejuvenate Hip Stem and the ABG II Modular Hip Stem Litigation, No. 296) The Stryker hip replacement lawsuits allege that the Rejuvenate and ABG II Modular-Neck Hip Stems implants cause serious health complications including tissue damage, metal poisoning and bone tissue degeneration.
In July 2012, Stryker recalled its Rejuvenate and ABG II Modular-Neck Hip Stems because of the potential for the hip replacement devices to fret and corrode at the modular-neck junction. During the recall, Stryker explained that the neck components of the Rejuvenate and ABG II are made of chromium and cobalt, and the stems are coated with titanium. Stryker further explained that metallic debris is generated when the neck components wear against each other as the recipient walks or runs, and the debris is released into the person’s bloodstream or tissue. According to Stryker, patients can experience such problems as pain and swelling, adverse local tissue reactions, and other problems due to the metallic debris shedding.

Court documents indicate that preparations for bellwether trials were underway in the New Jersey State Court and the federal court in Minnesota prior to Stryker settlement announcement. In a pretrial order issued in September, U.S. District Judge Frank ordered attorneys to submit a list of lawsuits that both sides agreed could be potential cases for bellwether jury trials, which have been scheduled for Summer 2015. in New Jersey, Judge Martinotti had tentatively scheduled Stryker hip bellwether trials for June 15, 2015 and July 13, 2015. Judge Martinotti ordered the plaintiffs’ and defendant’s attorneys to continue working on selecting cases for the bellwether trials and he would set up a briefing schedule if the attorneys had not reached an agreement by November 17, 2014.
