According to a Lawsuit filed by the Law Office of Twila S. White, Ralphs Grocery Company Sued for Wrongfully Terminating a 36 year Employee with Breast Cancer
Los Angeles, California (PRWEB) December 17, 2014 -- A 36 year employee of Ralphs Grocery Company who has breast cancer and took a medical leave has sued for disability discrimination and wrongful termination.
According to court documents, the employee worked for the Ralphs Grocery Company in Los Angeles, California. The complaint alleges that Ralphs is a subsidiary of The Kroger Company and is a grocery store chain with approximately 220 stores. The lawsuit alleges that the Kroger Company has more than 2,600 stores in 34 states, employs at least 375,000 associates company wide and has annual sales of more than 98 billion. The Kroger Company, as stated in court documents, ranks as one of the world’s largest retailers.
In her 36 years of working at Ralphs, Plaintiff’s lawsuit states that she started out as a courtesy clerk, before being promoted to a cashier, and later performed the positions of self check attendant and store greeter.
The lawsuit alleges that Plaintiff was diagnosed with breast cancer in February 2013, while at the same time suffering from a work injury involving a torn meniscus. Plaintiff’s lawsuit alleges that she began taking Thursdays off for chemotherapy and radiation treatments, and eventually went out on a medical leave. She alleges that while on medical leave, she sought financial assistance from Ralph’s Helping Hands Program, but Ralphs denied her request, stating that she did not meet the criteria for assistance.
The lawsuit further alleges Ralphs terminated Plaintiff’s medical insurance while she was out on medical leave, interfering with her lifesaving cancer treatments and examinations that she desperately needed, and proceeded with also terminating her employment once she was released to return to work.
The lawsuit seeks compensatory and punitive damages, including lost earnings, medical damages, damages for pain and suffering, and emotional distress damages.
