Actos Lawsuit Trial Continues to Move Forward in Las Vegas, Shortly after $9 Billion Punitive Damage Award Handed to Plaintiff in First Federal Hearing for Actos Case

The Las Vegas Review Journal reports that a plaintiff in this case testified on April 15th that she would not have taken Actos, which is manufactured by Takeda Pharmaceuticals, if she had known its alleged risk for causing bladder cancer. Less than two weeks prior to this Actos lawsuit update, the first federal trial for a lawsuit over the diabetes medication concluded on April 7, 2014 in the U.S. District Court, Western District of Louisiana with a $9 billion punitive damage award to the plaintiff, who also received $1.475 million in compensatory damages. A Case List updated April 15th by the U.S. Judicial Panel on Multidistrict Litigation (JPML) indicates that 2,993 additional claims against Takeda are now pending in a federal multidistrict litigation (MDL) established in the Western District of Louisiana. Claims in this proceeding similarly allege that the Actos manufacturer not only failed to warn about bladder cancer side effects that may allegedly stem from use of its diabetes drug, but also concealed vital safety information from the public and medical community. According to court records, the number of lawsuits over Actos has continued to increase since June 2011, when the U.S. Food and Drug Administration (FDA) warned the public that individuals taking it for longer than 12 months may be associated with a doubled risk for new-onset bladder cancer.
