Actos Lawsuits Move Forward, as Second Pilot Bellwether Trial in Federal Actos Bladder Cancer Litigation is Put on Hold, Bernstein Liebhard LLP Reports
New Yor, New York (PRWEB) January 26, 2014 -- Actos lawsuits (http://www.consumerinjurylawyers.com/actos/Actos-Lawsuit.html) alleging long-term use of the Type 2 diabetes drug can cause bladder cancer continue to move forward in the federal multidistrict litigation now underway in U.S. District Court, Western District of Louisiana, Bernstein Liebhard LLP reports. According to an Order issued on January 15, 2014, the Court has continued the litigation’s second pilot bellwether trial until further notice, and has suspended all deadlines previously set in the matter. The Order further directs the litigation’s Special Masters to schedule a telephone conference within the next two weeks to establish a new date for the trial, which was originally scheduled to begin on April 14, 2014. Actos and Bladder Cancer
The federal Actos litigation was established in December 2011, following an alert issued by the U.S. Food & Drug Administration in June of that same year which warned that use of the medication for a year or more could be associated with an increased risk of bladder cancer. According to court documents, nearly 2,700 Actos bladder cancer claims have since been filed in the proceeding, all of which accuse Takeda Pharmaceuticals of concealing the medication’s link to bladder cancer, and failing to provide adequate warnings to doctors and patients. The litigation’s first bellwether trial is scheduled to start on Monday, January 27, 2014.
Court documents indicate that scores of Actos lawsuits involving similar allegations have been filed in state courts around the country, three of which went to trial last year. In April, an Actos bladder cancer plaintiff was awarded more than $6.5 million by a Los Angeles Superior Court Jury in September. However, that verdict was set aside by the judge overseeing the case, and is currently on appeal. (Cooper v. Takeda Pharmaceuticals America Inc., CGC-12-518535, California Superior Court)
In September, a Maryland State Court jury awarded $1.7 million to the family of a man who died of bladder cancer following long-term use of Actos. However, the judge presiding over the lawsuit overturned the verdict because the jury also found that the decedent’s decades-long smoking habit contributed to the development of the disease. (An v.
