Stryker hip replacement lawsuits have been filed in state and federal courts across the country.
A number of cases filed in the state of New Jersey, have been consolidated in the Bergen County Superior Court, Law Division, under case number 296. According to the New Jersey Judiciary website, Stryker Orthopaedics acknowledges the potential issues with the hip implants. Similarly, all Stryker hip replacement lawsuits filed in United States Federal Courts have been consolidated in the United States District Court for the District of Minnesota under case number MDL No. 13-2441.
The July 2012 recall of the Rejuvenate and the ABG II metal-on-metal hip implants by Stryker Orthopedics occurred after the FDA received over sixty reports of the systems failing. According to a Stryker press release posted on the FDA’s website:
Stryker Orthopaedics’ decision to voluntarily remove Rejuvenate and ABG II modular-neck stems and terminate global distribution of these products comes after continued post-market surveillance. The post-market surveillance data may be predictive of a trend. [S]tryker has notified healthcare professionals and regulatory bodies of this voluntary recall. Patients who received a Rejuvenate Modular or ABG II modular-neck stem are encouraged to contact their surgeon. Patients uncertain if they have one of these products implanted should contact their surgeon or consult their medical records.
Additional information provided by Stryker notes that the risk associated with its recalled modular neck stems include “the potential for fretting and/or corrosion at or about the modular-neck junction, which may result in adverse local tissue reaction, as well as possible pain and/or swelling, in or around your hip.”
Due to the recall, Stryker has offered reimbursement for only very specific medical expenses incurred by patients with the recalled hip implant, in addition to other unspecified “costs relating to this voluntary recall,” through Broadspire Services (the third party Stryker partnered with to handle hip implant claims). But some cases may require compensation for damages beyond what Stryker is offering, which is why legal counsel may become a need for some patients.
With increasing information in the media, as well as letters sent to Stryker hip implant patients by Broadspire, many are searching for credible, accurate information regarding Stryker hip implants and Stryker lawsuits. This is why the Stryker Hip Recall Information Center has been created. The website is a one-stop location where an individual can get information about Stryker metal-on-metal hips and any potential claims he or she may have. If there are questions left unanswered, an individual can submit confidential written information about their claim or speak to a Stryker hip recall lawyer by phone for immediate assistance.
