Anthony Rickman Gets Charges Dropped Against Father in “Suicide Pact” Case

The Hillsborough County State Attorney’s office agreed and dropped all of the criminal charges against James Clark (Case No. 13-cf-007465, Hillsborough County Courthouse). If convicted of these charges, Mr. Clark would have spent the rest of his life in prison.
Recently, the state of Florida charged Mr. Clark’s accuser and ex-wife Nancy Lowe with attempted murder, arson, and child neglect in relation to this incident (Case No. 13-cf-14747, Hillsborough County Courthouse).
According to court documents, on May 25, 2013, James Clark claimed he received a call from a neighbor telling him that his ex-wife’s car and house were on fire and that he needed to respond to the residence because his daughter was in the vehicle. Mr. Clark claimed that, prior to receiving this phone call, he had reported his daughter missing and believed that his ex-wife Nancy Lowe had taken her from school.
Court documents then show Mr. Clark claim that, upon arriving at the scene of the fire, he saw what he believed to have been his ex-wife placing herself and their 12-year-old daughter inside a vehicle and lighting it on fire in an attempt to kill them both.
Attorney Anthony Rickman and his client alleged that, in an attempt to avoid responsibility for her actions, Ms. Lowe claimed that her ex-husband James Clark drove her and her daughter to make a “suicide pact.” Due to these and other allegations, police arrested Mr. Clark for burglary and battery. Ms. Lowe was not initially arrested.
According to court documents, Anthony Rickman provided the State and law enforcement with sufficient evidence to disprove allegations that Mr. Clark drove his ex-wife to make the suicide pact and therefore, Mr. Clark’s charges of burglary and battery were dropped.
