Hip Implant Litigation
Stryker Rejuvenate and ABG II hip stems were subject to a global recall in July 2012, after post-market surveillance data indicated the metal components were prone to fretting and corrosion at the modular neck junction.** Since then, thousands of people have filed product liability lawsuits against Stryker for injuries they allegedly sustained due to their failure. These cases include more than 2,160 cases that are pending in New Jersey’s Bergen County Superior Court, where Bernstein Liebhard LLP is actively filing claims. On November 3, 2014, a Stryker hip settlement program was announced in Bergen County Superior Court, which could ultimately resolve thousands of state and federal claims involving Rejuvenate and ABG II hip stems. According to court documents, the settlement provides for gross base awards of $300,000 per failed implant, with potential deductions and enhancements based on the particulars of each case, including additional compensation for claimants who suffered complications during revision surgery and for other damages, including future surgeries caused by complications. The settlement also provides compensation for individuals who need a revision but are medically unable to undergo the surgery. Claimants may begin receiving their awards by the summer of 2015.
Court documents also indicate that more than 6,900 DePuy Pinnacle hip lawsuits involving a metal-on-metal version of the device that utilizes the Ultamet liner are currently pending in a federal multidistrict litigation underway in U.S. District Court, Northern District of Texas. All of the claims similarly allege that the all-metal design created by this configuration makes the hip implant prone to premature failure and other complications, including metallosis (metal ion poisoning) and chronic pain.
