Associate Broker Merry Silbaugh Has a CARLOAD of Integrity

According to a release from June 23, 2015 on The United States Department of Justice's site, Reyes and his co-conspirators participated in a mortgage fraud scheme that resulted in losses of just under $2 million (Case No. CR-12-01122, Department of Justice U.S. Attorney’s Office - District of Arizona). According to the release, they also provided false information to lenders, used straw buyers to perpetrate the scheme and obtained at least fourteen loans on eleven properties that totaled over $3 million, which resulted in nine foreclosures.
To combat such instances and find a reputable agent, Merry suggests finding licensed real estate agents that are bound by law to uphold a standard of care set forth by the Arizona Real Estate Commissioner, what is referred to as CARLOAD. The acronym stands for Confidentiality, Accounting – a responsibility to protect the client, Reasonable care and diligence, Loyalty, Obedience to lawful instructions, Accountability – for one’s actions, and Disclosure.
“This standard of care is reinforced through training, monitoring and disciplinary action for those who do not abide by the standard,” said Merry. “It is extremely important for agents to follow this standard for each and every client.”
Merry also stresses the importance of finding Realtors that abide by the National Association of Realtors (NAR) Code of Ethics. The NAR code, in part, outlines the duties to clients and customers, stating, “When representing a buyer, seller, landlord, tenant, or other client as an agent, REALTORS® pledge themselves to protect and promote the interests of their client. This obligation to the client is primary, but it does not relieve REALTORS® of their obligation to treat all parties honestly. When serving a buyer, seller, landlord, tenant or other party in a non-agency capacity, REALTORS® remain obligated to treat all parties honestly.”
