Attorney James T. Dufour Achieves Penalty Reduction
Sacramento, CA (PRWEB) April 24, 2014 -- Attorney James T. Dufour, of Dufour Seminars, recently achieved a significant penalty reduction in a hazardous waste case. The client, R-Squared Circuits, Inc., agreed to pay $75,000 to settle 11 serious violations resulting from a California Department of Toxic Substances Control (DTSC) inspection in Dec. 2011.
Dufour represented R-Square Circuits, Inc. in the case of the People of the State of California, ex. rel. Deborah O. Rapheal, Director of Department of Toxic Substances Control v. R-Squared Circuits, Inc. (Case no. 34-2013-00151864 in the Superior Court of the State of California). According to the civil complaint filed concurrently by the attorney general with the settlement stipulation, the appropriate amount of penalties was $445,334. At one point in this proceeding, the penalty demand was as much as $1.7 million.
R-Squared Circuits, Inc. operated a printed circuit board manufacturing plant in Folsom, California, which included tiered permitted state-of-the-art process wastewater treatment and recycling systems, and a circuit board trimming dust collection system. The DTSC’s allegations were, in part, based on interpretations of the state’s Title 22 hazardous waste regulations, which are vastly different from federal RCRA regulations and even conflict with California Health and Safety Code provisions that exempt certain recycling activities and air-cleaning devices as subject to hazardous waste regulation.
