Attorney Lorie Fowlke Advocates for Uniform Family Law Arbitration Act
Provo, UT (PRWEB) April 13, 2016 -- Lorie Fowlke, a partner at Scribner Fowlke Attorneys at Law, a Utah State Commissioner for the national Uniform Law Commission, serves on the Uniform Family Law Arbitration Act committee and recently attended a drafting committee meeting in an effort to create a Uniform Family Law Arbitration Act. “All states have either passed the Uniform Arbitration Act or the revised Uniform Arbitration Act, but those are geared mostly toward commercial transactions,” said Fowlke. “This committee’s proposed act, however, is specifically for family law, and if we create a Uniform Arbitration Act for family law cases everybody will be operating with the same rules.”
Furthermore, creating a Uniform Family Law Arbitration Act will shorten the wait time to get into court and also ensure people have an arbitrator that understands family law or a related specific issue. The Family Law Arbitration Act committee will present its proposal at a summer meeting in Vermont, scheduled for July 8-14, where it will receive feedback from approximately 350 lawyers from the Uniform Law Commission, a national organization of judges, lawyers, law professors and legislators that create uniform laws. They first presented the proposal last year. Afterward, they again met in committee, analyzed the feedback and created a bill that covers all the bases. This summer is the final reading for this act, and then it is ready to be proposed in state legislatures across the country.
“The benefit of getting feedback at the summer meeting is having 300 or so legally trained professionals from all over the country and different disciplines provide their perspective,” said Fowlke. “Here a representative can say, for example, ‘Well, I’m from Alaska and this would not apply to us because of …,’ and we will try to make it work for everybody.”
After approving the laws the drafting committee creates, they are presented to state legislators in the hope individual states will pass them. If passed, everybody in the country has the same laws on specific issues.
