Attorney Marshall H. Hong Helms an Immigration Issue Blog
Skokie, IL (PRWEB) July 18, 2015 -- Immigration attorney Marshall H. Hong has instituted a blog to help educate those facing immigration issues. Most recently, Hong, who has been practicing law for almost 20 years, weighed in on Deferred Action programs, in particular the Deferred Action for Childhood Arrivals (DACA) program, which allowed for certain individuals who were, as of June 15, 2012, present in the U.S. illegally to request that they be allowed to remain in the U.S. temporarily (for a period of two years) and to apply for employment authorization during that two-year period.
“On November 20, 2014, President Barack Obama announced that he would expand the Deferred Action program by Executive Order,” said Hong. “These expansions would have allowed for additional ‘childhood arrivals,’ as well as some parents of U.S. citizens and permanent residents of the United States, presently in the U.S. illegally, to nevertheless remain in the U.S. without fear of deportation, and to apply for authorization to work legally in the U.S.”
However, according to the blog post, the legality of the Executive Orders was challenged in federal court, resulting in the court temporarily blocking the programs from going into effect. The programs currently remain on hold, pending final ruling by the court as to whether the president acted within his authority in issuing the Executive Orders.
“Instead of changing the laws to allow for these individuals to remain in the U.S., the president effectively instructed a Federal Executive Agency (the Department of Homeland Security) on how to prioritize their job of enforcing the immigration/deportation laws of the U.S.,” said Hong. “Namely, not to act to deport these otherwise deportable individuals. Opponents and critics of the program argued that the Executive Orders were actually an attempt by the president to bypass Congress to effectively change the immigration laws.”
