Fraud in construction is rarely easy to handle, even if it is obvious and on the surface. Subtle fraud is more difficult to understand and prove. Gregory Smith, a construction savvy attorney with King & Spalding in Atlanta will be joining us to address the "Nuances of Fraud - From a Legal Perspective." Mr. Smith will provide insights into what is and isn’t fraud, evidence to look for, fraud in private versus public projects, and resolving disputes when dealing with fraud.
A forensic auditor will share his recent experiences “Building a Forensic and Compliance Team” and Courtenay Thompson will comment on current construction fraud cases.
Open discussions add value by offering attendees the opportunity to relate what has worked best and learn from the experiences of others. Specific fraud-related topics to be addressed in facilitated discussions include:
• How much construction contracting overcharge is intentional?
• How have kickbacks surfaced?
• What control breakdowns have led to fraud in construction?
• What are the most common overcharges identified by auditors?
• How are auditors and project management addressing gift & entertainment issues?
In addition to fraud-related presentations, Sean Stevens of Bartlett Cocke in Austin will give us a contractor’s perspective on working with owner auditors in “Construction Management Controls for a Seamless Audit.” James Miller of Baker Tilly in Charlotte explores “Auditing Insurance Programs – What the Insurance Underwriters Don’t Do.” Learn from an expert’s presentation on “Managing Subcontract Change Order Pricing.”
Facilitated discussion topics will also include:
• What construction audits are of the most value to project owners?
• What lessons are we learning from construction project failures?
• How are attitudes evolving on managing construction risks?
