Auger & Auger Comment on Recent Rollover Crash
(PRWEB) August 06, 2013 -- Police have not identified the cause of a rollover crash that injured six people Friday. According to car accident attorney Herb Auger, unless some unknown factor in the crash is uncovered it's likely that the driver of the vehicle will be liable for all injuries.
The vehicle was heading south on I-85 Friday afternoon near Landis and China Grove. From footage of the scene it appears the vehicle ran off the road and then flipped over on a grassy slope before coming to rest among trees. All six victims were taken to the hospital, with two in critical condition and two in serious condition according to NBC News (7.23.13).
“Normally, whoever causes a car accident is responsibility for the medical costs of all involved,” said Auger, the founder of Auger and Auger law firm and a dedicated victim advocate. “When there's only one vehicle involved, we have to look at the driver as the probable cause.”
Auger said that there could be other factors that would exonerate the driver – such as a slippery surface, a damaged road, or another vehicle's erratic driving.
“The police haven't mentioned any of these and there's no sign of them in the footage,” Auger said. “Vehicles don't just swerve off the road on their own, so the implication is some lapse of judgment by the driver.”
According to Auger, victims often don't want to take legal action against their friends, but if the medical costs are high enough it's a necessary choice.
“Legal compensation exists to make sure innocent victims don't suffer financially for what was done to them,” he said. “Whoever is at fault has to pay.”
