Award Winning Los Angeles Basketball Coach Exonerated in Jury Verdict After Being Charged with 13 Criminal Counts

A jury trial was held in Los Angeles Superior Court, resulted in coach Miller walking away from the court room a free man. According to the court records Coach Miller was charged with eight counts of illegal filming, one count of sexual battery, and four counts of battery.
A three day suppression hearing was held before jury selection, in Department 54 of the Clara Shortridge Foltz Criminal Justice Center (case number 4CA00067). According to court records (minute order 6/10/15) the honorable Judge Kerry Bensinger partially granted defense counsel's motion to dismiss four counts due to inappropriate methods used by the Los Angeles Police Department.
According to court documents an eleven day jury trial followed the suppression hearing. The prosecution called five witnesses during their case in chief. The defense called twelve witnesses during its case in chief, including coach Miller, who testified in his own defense. The jury deliberated for nearly two full days resulting in a verdict of not guilty on the sexual battery count and the four counts of battery.
Court records show the jury could not reach a verdict on the remaining counts of illegal filming and a mistrial was declared by the court on June 30, 2015. On July 22, 2015, the Honorable Judge Bensinger denied the People’s motion to reinstate the illegal filming counts against coach Miller and dismissed the hung counts in the interests of justice.
