According to a Calendar posted on the Court’s website, parties involved in the federal litigation will meet on March 13, 2015 at 1:30 p.m. to address matters related to prescription therapy treatments designed to raise levels of the male hormone. According to a listed number of cases found on the Northern District of Illinois’ website, more than 1,147 testosterone lawsuits had been centralized in the proceeding at the end of February 2015. All these cases, including the ones filed by attorneys at Bernstein Liebhard LLP, follow the federal litigation’s creation in June 2014, and a public health alert issued a few months earlier by the U.S. Food and Drug Administration (FDA). According to the federal agency’s notice on January 31, 2014, certain testosterone medications may cause an increased risk of cardiovascular injuries in younger men with a pre-existing history of heart disease and all older men older than 65.
A federal panel convened by the FDA then met in September 2014 to further discuss the issue, and recommended that the labeling on testosterone products be revised to make clear that they have not been proven effective in treating low libido, loss of muscle mass, fatigue and other issues that often occur in men as they age. Advisers also recommended that testosterone manufacturers be required to conduct large-scale studies to assess their possible association with heart problems.
According to court documents, all the testosterone lawsuits now pending in Illinois federal court allege life-threatening cardiovascular injuries, as well as deep vein thrombosis and pulmonary embolism, caused by several medications. Plaintiffs in these cases further allege that manufacturers of these products concealed these risks in order to protect their market share.
