Judge Robert L. Miller Jr., who is overseeing the federal Biomet hip lawsuits, had issued an Order on October 9th directing the parties to weigh in on the special master appointment. According to that Order, defense counsel has until November 1st to file an objection with the Court.

Court documents indicate that at least 725 Biomet hip lawsuits have been filed in the Northern District of Indiana since the multidistrict litigation was established just over a year ago. Plaintiffs in these claims allege that the Biomet M2a Magnum’s chromium-cobalt ball and cup can wear, causing dangerous amounts of metal ions to accumulate in recipients’ tissue and blood stream. They further allege that the accumulation of this toxic metal debris may cause serious and debilitating complications which often necessitate revision surgery to remove and replace the implant.
The U.S. Food & Drug Administration (FDA) warned in January 2013 that metal-on-metal hip replacements had been associated with higher rates of early failure compared to those made from other materials. The FDA has advised recipients of all-metal hips to undergo metal ion blood testing if they experience any symptoms that would indicate their device could be failing. The agency has also proposed new regulations that would subject such implants to more regulatory oversight.
