Bladder Mesh Lawsuit News: Jury Orders Boston Scientific To Pay $18.5 Million Award After Finding Company Liable For Selling Defective Mesh, The Oliver Law Group Reports
New York NY (PRWEB) November 24, 2014 -- Bladder Mesh Lawsuit News: A federal jury in West Virginia today ordered Boston Scientific Corp. to pay $18.5 million to four women who said they suffered such injuries as mesh erosion, organ damage and pain due to the company’s Obtryx transvaginal mesh implant, The Oliver Law Group P.C. reports. According to Bloomberg, U.S. District Court, jurors in the Southern District of West Virginia found Boston Scientific liable for selling defective pelvic mesh devices. The jury also determined that the company failed to adequately warn the women and their doctors about the risks associated with its Obtryx mesh implant. The 10-day trial combined claims from the four bladder mesh lawsuits filed by the women. Reuters reported that the trial in West Virginia ended with the jury also ordering Boston Scientific to pay damages to each of the four women ranging from $3.25 million to $4.25 million. Additionally, the jury found the company acted with “gross negligence” and awarded each woman $1 million in punitive damages. According to Reuters, the women alleged that they suffered such injuries as nerve damage, infection and pain during sex because of the Obtryx vaginal mesh device. Boston Scientific issued a statement to Reuters saying that the company did not agree with the verdict and is weighing its appeals options. Boston Scientific recently had a jury verdict reduced, Reuters reported. In September, a Texas state court jury awarded $73 million to a woman who said she suffered permanent injuries from the Obtryx bladder mesh. The trial judge reduced the award to $34.6 million. According to the U.S. Food and Drug Administration (FDA), transvaginal mesh devices are used to support the bowel, bladder, and uterus when they weaken, drop from their normal position and bulge into the vagina. The FDA issued warnings about pelvic mesh devices in 2008 and 2011 due to complaints received from women who suffered vaginal scarring, bleeding, shrinkage, pelvic pain and other complications after they had transvaginal mesh implants. In September 2011, the FDA convened a meeting of its Obstetrics and Gynecology Devices Panel to discuss concerns over transvaginal mesh products. The panel recommended that the FDA reclassify the transvaginal mesh devices from “moderate risk” to “high risk” because the safety and effectiveness of the devices have not been established.

Court records indicate that pelvic mesh lawsuits filed against Boston Scientific continue to increase in the U.S. District Court, Southern District of West Virginia where pelvic mesh lawsuits are pending in multidistrict litigation. The court’s master case list shows mesh lawsuit complaints against Boston Scientific rose from 14,094 as of October 15, to 14,272 as of November 17. The pelvic mesh lawsuits were filed on behalf of women who allege that they suffered from mesh erosion, vaginal scarring, bleeding, pelvic pain and other problems as a result of having a transvaginal mesh implant. Bloomberg reported that Boston Scientific’s loss of three trials since September adds pressure to the company to settle thousands of pending lawsuits. In its third quarter filing to the U.S. Securities and Exchange Commission, Boston Scientific reported that in addition to the multidistrict litigation in West Virginia, over 2,500 transvaginal mesh lawsuits are pending against the company (in Middlesex County Superior court) in Massachusetts.
