Bladder Mesh Lawsuits Continue with February Conferences for C.R. Bard and Ethicon Inc., Reports Wright & Schulte LLC

According to the court’s calendar, a 10:30 a.m. conference has been scheduled for the C.R. Bard bladder mesh litigation and a 1:30 p.m. conference has been scheduled for Ethicon Inc’s Gynecare pelvic mesh litigation. The bladder mesh lawsuits filed against Bard and Johnson & Johnson’s Ethicon unit have common allegations from women who had transvaginal mesh implants to treat pelvic organ prolapse or to treat stress urinary incontinence and experienced such serious side-effects as mesh erosion, bleeding, chronic pain, pain during sexual intercourse, as a result of the medical devices. According to Superior Court’s master case list, 7,487 lawsuits have been filed in the Ethicon Gynecare litigation while 1,648 cases are pending against Bard, as of January 17. In addition to Bergen County Superior Court, C.R. Bard has bladder mesh lawsuits pending in the U.S. District Court, Southern District of West Virginia. Bloomberg News reported that U. S. District Judge Joseph Goodwin, who is presiding over the coordinated proceedings for the mesh lawsuits, made an unusual move by telling Bard’s attorneys that Bard could possibly lose billions of dollars in jury verdicts if the company chooses not to settle the mesh complaints for a lesser amount. Judge Goodwin reminded the company of the large verdicts that juries have recently awarded women who claim they were injured after using the company’s mesh products.

In October, Bloomberg reported that Bard agreed to pay $21 million to settle more than 500 bladder mesh lawsuits. The settlement agreement calls for the company to pay an average of $43,000 per claim. Court records indicate that there are 10,080 pelvic mesh lawsuits pending against Bard in the West Virginia federal court litigation as of January 15. (In re: C.R. Bard Inc. Juries have also awarded large verdicts against Ethicon over its bladder mesh medical devices, according to court records. For instance, a jury in New Jersey’s Atlantic County Superior Court rendered an $11 million verdict ($3.35 million in compensation and $7.76 million in punitive damages) against Ethicon in February 2013. (Atl-L-6966-10) In April 2014, a jury in the District Court for the 95th Judicial District, Dallas County, Texas awarded a woman $1.2 million in compensatory damages and a federal jury in West Virginia awarded a woman $3.27 million in September 2014.
