Boston Scientific Transvaginal Mesh Lawsuit Plaintiffs Awarded $26.7 Million in Federal Bellwether Trial, Bernstein Liebhard LLP Reports
New York, New York (PRWEB) November 14, 2014 -- A Florida jury hearing one of the first federal trials to involve transvaginal mesh lawsuits (http://www.vaginalmeshlawsuit2015.com/) filed against Boston Scientific Corp. has ordered the company to pay a total of $26.7 million to four women who suffered complications related to the Pinnacle Pelvic Floor Repair Kit, Bernstein Liebhard LLP reports. In a verdict rendered yesterday in the U.S. District Court, Middle District of Florida, the jury awarded each of the Plaintiffs between $6.5 million and $6.7 million in compensatory damages. Court records indicate that the jury delivered its verdict following eight days of testimony and just a few hours of deliberations. All of the Plaintiffs said they suffered pain, infections, bleeding and other vaginal mesh complications following implantation of the Pinnacle mesh device to treat pelvic organ prolapse. During the trial, Boston Scientific was accused of rushing the Pinnacle product to market, and of failing to conduct adequate studies of its safety and effectiveness.

Transvaginal Mesh Litigation
According to court documents, Boston Scientific is currently facing more than 14,000 transvaginal mesh lawsuits that have been filed a multidistrict litigation established in the U.S. District Court, Southern District of West Virginia. All of the claims pending in this proceeding were filed on behalf of women who allegedly suffered mesh erosion, chronic pain, organ damage and other serious vaginal mesh complications as a result of the company’s products. A second bellwether trial is now underway in West Virginia, and involves four Plaintiffs who were allegedly injured by Boston Scientific’s Obtryx sling. (Tyree, et al. v. Boston Scientific Corp., No. 2:12-8633)
Court records indicate that several Boston Scientific mesh trials have concluded in state courts. The most recent ended in September, when a jury in Texas ordered the company to pay $73 million in punitive and compensatory damages to a woman who was injured by Obtryx mesh. However, punitive damages were later reduced in the case to comply with Texas law, reducing the total judgment to $34 million. (Salazar v. According to court documents, more than 60,000 transvaginal mesh lawsuits are currently pending in several litigations underway in the Southern District of West Virginia. Mr. Grand is a also a member of the Plaintiffs’ Steering Committee for other federal proceedings, including those involving American Medical Systems, Inc. (MDL No. 2325), C.R. Bard, Inc. (MDL 2326) and Ethicon, Inc. (MDL No. 2327).
Mr. Grand was also appointed Co-Liaison Counsel in two consolidated proceedings established for C.R. Bard and Ethicon mesh lawsuits in New Jersey's Atlantic Superior Court. He was also a member of the plaintiff’s trial team for the state’s first Ethicon trial, which ended in March 2013 with an $11 million verdict for a woman who experienced vaginal mesh complications related to the Gynecare Prolift device.
