Boston Scientific Transvaginal Mesh Lawsuits Move Forward, With Issuance of New Order in Federal Litigation, Bernstein Liebhard LLP Reports
New York, New York (PRWEB) December 09, 2014 -- Thousands of transvaginal mesh lawsuits (http://www.vaginalmeshlawsuit2015.com/) filed against Boston Scientific Corp. continue to move forward in the federal multidistrict litigation now underway in U.S. District Court, Southern District of West Virginia, Bernstein Liebhard LLP reports. According to a Pretrial Order dated November 21st, the Court has established new deadlines pertaining to discovery in Wave 1 and 2 bellwether cases. Among other things, the Order directs that certain motions must be filed with the Court no later than January 16, 2014. Opposition briefs are to be filed by January 30th, while any reply briefs must be received by February 6th. Vaginal Mesh Litigation
According to court documents, Boston Scientific is named a defendant in more than 14,000 transvaginal mesh lawsuits now pending in the Southern District of West Virginia. All of the claims were filed on behalf of women who allegedly suffered mesh erosion, chronic pain, organ damage and other serious vaginal mesh complications as a result of the company’s products.
Court records indicate that litigation recently concluded its first two bellwether trials. On November 20th, a jury hearing a case involving Boston Scientific’s Obtryx bladder sling awarded more than $18 million in compensatory and punitive damages to the four women named as plaintiffs in the case. Boston Scientific Corp., No. 12-cv-8633) Just a week earlier, four others who suffered complications related to the Pinnacle Pelvic Floor Repair Kit were awarded a total of $26.7 million in compensatory damages. According to court filings, more than 65,000 transvaginal mesh lawsuits are currently pending in several litigations underway in the U.S. District Court, Southern District of West Virginia.
