Buffalo, NY Truck Accident Lawyer James Morris Comments On New Texting Laws For Truckers
Buffalo, NY (PRWEB) November 25, 2013 -- Buffalo, NY truck accident attorney James Morris of the Law Offices of James Morris said today that new texting laws for truckers send a stern message to truck drivers that cell phone use – especially texting while driving – will not be tolerated in New York State.
According to the Democrat & Chronicle (“Tougher texting laws start Monday for truck drivers,” October 25), laws banning drivers with commercial licenses from using their phones took effect Oct. 28. The laws prohibit drivers from using their phones even at traffic stops, the article states.
“Our firm applauds the continual efforts of Governor Cuomo to combat texting while driving, which has emerged in recent years as a clear and present threat to drivers across the Empire State,” said Morris, who represents victims of negligence and families who lost loved ones in accidents. “This most recent measure is a message to truck drivers that cell phone use anytime behind the wheel will not be tolerated. Trucking accidents are some of the most devastating types of injury cases we handle.”
The Democrat and Chronicle said the new law forbids truck drivers from using a cell phone or a “portable electronic device while the vehicle is temporarily stationary because of traffic, a traffic control device, or other momentary delays.” A violation of this law could lead to a mandatory suspension of a commercial driver’s license, according to the article.
Furthermore, the Democrat and Chronicle article stated that this new law was preceded by a law in July 2013 that raised the penalties for texting and driving and a 2011 law that made texting and driving a primary offense in the state, leading to a sharp increase in tickets issued for texting and driving.
“It’s a known fact that texting while driving is extremely dangerous in Buffalo and throughout New York State. But many drivers still choose to text– including truck drivers who are responsible for vehicles that are much larger and heavier than passenger vehicles,” said Morris, a truck accident lawyer in Buffalo. “If a truck driver takes his or her eyes off the road for as much as a split-second, it’s possible for a catastrophic accident to occur that could cause fatal injuries to an innocent driver, passenger, or pedestrian.”
Morris said lawyers can help hold negligent truck drivers accountable. Attorneys can help victims and families who lost loved ones pursue compensation and send a message that negligent behavior on New York roads will not be tolerated.
