Byetta Lawsuits Mount, as Federal Product Liability Claims Involving Incretin Mimetics Diabetes Drugs Surpass 400, Bernstein Liebhard LLP Reports
New York, New York (PRWEB) May 17, 2014 -- Byetta lawsuits (http://www.byettalawsuit.com) and other product liability claims involving a class of diabetes drugs called incretin mimetics continue to mount in a federal multidistrict litigation now underway in U.S. District Court, Southern District of California, Bernstein Liebhard LLP reports. According to an updated Docket Report issued by the U.S. Judicial Panel on Multidistrict Litigation (JPML) on May 15, 2014, at least 414 complaints alleging a link between medications like Byetta and pancreatic cancer are pending in the proceeding. That’s an increase of more than 60 filings since the JPML last issued an update in April, when just over 350 cases were noted. Byetta Pancreatic Cancer Allegations
Byetta, Januvia, Victoza and other incretin mimetics are used in combination with diet and exercise to reduce blood sugar levels in people with Type 2 diabetes. As the name suggests, these medications mimic the action of incretin hormones in the intestinal tract to stimulate the pancreas to release insulin. Court documents indicate that the litigation surrounding these drugs has been growing since March 2013, when the U.S. Food & Drug Administration (FDA) announced it was investigating findings from an unpublished study that indicated their use could be associated with cellular changes in the pancreas called pancreatic duct metaplasia, a precursor to cancer. Though the agency has been unable to conclude that such a link exists, its review is ongoing.
One month after the FDA announced its incretin mimetics review, the Institute for Safe Medicine Practices revealed that the FDA had received 263 reports of pancreatitis, 71 cases of pancreatic cancer, and 14 incidents of thyroid cancer among patients taking Byetta in a single 12-month period. The same review also found that compared to other classes of diabetes medications, incretin mimetics were far more likely to be associated with pancreatic cancer.*
According to court documents all of the lawsuits pending in the Southern District of California allege that the manufacturers of Byetta and other incretin mimetics concealed their potential to harm the pancreas, and failed to provide doctors and patients with adequate warnings about this risk. In additional to the claims pending in the federal proceeding, court records indicate that a number of Byetta lawsuits have been consolidated in a state-level litigation underway in California Superior Court.
