C.R. Bard Transvaginal Mesh Lawsuit News: Settlement Reached in Bellwether Trial Scheduled to Commence This Week, Bernstein Liebhard LLP Reports

Bard Inc. has agreed to settle a bellwether transvaginal mesh lawsuit (http://www.vaginalmeshlawsuit2015.com/) that was scheduled to go to trial this week in the federal litigation underway in the U.S. District Court, Southern District of West Virginia, Bernstein Liebhard LLP reports. According to court documents, the complaint had been filed on behalf of a woman who allegedly suffered serious vaginal mesh complications related to the company’s Avaulta Plus Anterior Support System and the Avaulta Plus Posterior Support System. Transvaginal Mesh Litigation
According to court documents, more than 10,000 transvaginal mesh lawsuits are currently pending against C.R. Bard in the Southern District of West Virginia, where Bernstein Liebhard LLP partner, Jeffrey S. Grand, is serving on the Plaintiffs’ Steering Committee. All of the lawsuits pending in the proceeding similarly allege that pelvic mesh devices marketed by C.R. Bard caused recipients to experience mesh erosion, organ damage, chronic pain, and other serious vaginal mesh complications. The lawsuits further claim that the company’s products were not subjected to adequate testing to ensure their safety, and that doctors and patients were not warned about their significant risks. Court records indicate that the federal litigation’s first C.R. Bard bellwether trial concluded in August 2013, with a jury awarding the plaintiff $2 million in compensatory and punitive damages. (Case No. 11-cv-00195) A week later, an undisclosed settlement was reached in what would have been the proceeding’s second bellwether trial. (Case No. 11-cv-00012)
According to court documents, more than 67,000 transvaginal mesh lawsuits have been filed in the Southern District of West Virginia against various medical device manufacturers.
