C.R. Bard Transvaginal Mesh Litigation Moves Forward as Federal Judge Orders 200 Lawsuits to be Slated for Discovery, Parker Waichman Reports

According to court documents, on January 16th federal Judge Joseph Goodwin of the U.S. District Court for Southern West Virginia ordered attorneys for the plaintiffs and the defense to select 100 lawsuits each. These selected cases will be prepared for trial, either in the Southern District of West Virginia or in the plaintiffs’ home districts. Judge Goodwin is overseeing thousands of cases in the C.R. Bard transvaginal mesh multidistrict litigation entitled In re C.R. Bard Inc. Pelvic Repair System Products Liability Litigation (MDL No. 2187).

Court documents show that there are almost 7,000 lawsuits over C.R. Bard’s Avaulta transvaginal mesh. Plaintiffs in the litigation suffered painful and sometimes permanent complications, allegedly due to the Avaulta. According to Court records, C.R. Bard was ordered to pay $2 million to the plaintiff at the conclusion of the first bellwether trial in August (Cisson et al. v. C.R. Bard Inc., Case No. 2:11-cv-00195, in the U.S. District Court for the Southern District of West Virginia). Court documents also indicate that the second bellwether trial was settled on the day the trial was scheduled to begin.
